Terms of Service
Effective date: 28 October 2026 · Last updated: 28 October 2026
1. Who we are
PHORM ("PHORM," "we," "us") is a service operated by Individual Entrepreneur "Phorm," registered in the Republic of Kazakhstan, IIN 000725500103, address: 24 Tulebayev St., apt. 25, Almaty, Republic of Kazakhstan. Contact: [email protected].
This Agreement governs your use of the website and application at https://phorm.to and all related services (the "Service"). By registering an account or using the Service, you accept these terms. Orders are processed by our online reseller and merchant of record, Dodo Payments (Dodo Payments Inc. and its affiliates), which also handles order-related inquiries and returns (§7).
2. Who can use the Service
You must be 18 or older to use the Service. The Service is not intended for children, is not addressed to them, and is not promoted to them. You confirm your age when you register; if we learn that an account belongs to a person under 18, we will close it and delete the associated data.
You also confirm that you are not located in a country under comprehensive sanctions, are not acting on behalf of a person or entity located there, and are not on any sanctions list, including the OFAC SDN list (United States).
3. What the Service does
PHORM turns a photograph — of an object, a pet, or a person — into a print-ready three-dimensional model: it reconstructs geometry from your image, automatically repairs the mesh (closing holes, fixing non-manifold geometry, correcting wall thickness), checks the result with our own printability validator, and issues a verdict before a model is charged. Finished results export as STL and 3MF files; for supported printers, 3MF files can include a print profile.
Around generation, the Service includes tools that do not create a new model: preparing your photo (generating a photo from a text description, editing a photo with a prompt, generating a view of the object from another angle, upscaling, removing a background, detecting the object), an editor for the finished model (engraving of text, logos, and QR codes; resizing), colour separation and manual painting for multi-material printing, and repair of your own STL, GLB, and 3MF files.
AI photos and other prepared images are working material for 3D generation: they are shown in the editor and kept in your library for the retention period in §8.4, but they are not provided for download as separate image files. The files you download are 3D models (STL and 3MF). The images remain yours under §8.2, and a copy of your data, including these images, is available on request under the Privacy Policy.
Photos of people. The Service can turn a photo of a person — or an AI photo made from it — into a 3D model of a figurine you can print, within the rules in §8.3 and §9. We do not try to find out who the people in your photos are and do not keep face or other biometric data. The Service does not offer face swapping and blocks requests for it.
The Service delivers digital files only. We do not manufacture, print, ship, or sell physical objects.
The Service also includes a gallery of models made by our team, which you can save, open in the editor, and download under §8.6.
The feature set of each plan is described on the pricing page and may evolve. We may change and improve the Service; we give notice of material changes affecting paid features as described in §14 and §16.
Generation relies on third-party AI models and compute providers, which we may replace or update; a change of provider does not change your rights under this Agreement. Features marked as beta or experimental are provided for evaluation and may be changed or withdrawn without notice.
4. Your account
You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for all activity in your account. Report any suspected compromise to [email protected].
Accounts are personal: transferring, selling, or sharing access to an account is not allowed. Every plan is for one person. If your team needs several seats, write to [email protected].
5. Models, AI photos, plans, and your balance
5.1 The units of use
Usage is measured in two units: models and AI photos.
A model is one generation of a 3D model. Except as set out in §6, every generation spends one model. Every generation, on every plan, Free included, can be made in High Quality with multicolour export. One charge covers generation, automatic mesh repair, the printability check, and export; AI photo operations you run on your image beforehand count as AI photos. Engraving, resizing, colour separation, manual painting, and re-downloading a model you already created spend nothing.
An AI photo is one image operation performed by our compute providers: generating a photo from a text description, editing a photo with a prompt, generating a view of the object from another angle, or upscaling. Removing a background and detecting objects are free. Each paid plan includes a monthly pool of AI photos; once the pool is used, an AI photo spends half a model — two photos for one model. On Free, AI photos come only from those Free includes (§5.2): models from packs and rewards are never spent on AI photos on Free.
What each operation spends is set out in this section. Your balance is always shown in the app, and an operation your balance does not cover is refused before anything is spent. Your balance is displayed in whole models and whole photos; a remaining half-model is shown as one photo.
5.2 Plans
| Plan | Price per month | Annual billing (−20%) | Models | AI photos |
|---|---|---|---|---|
| Free | $0 | — | 2, once | 6, once |
| Hobby | $9 | $86.40 per year | 10 per month | 20 per month |
| Maker | $19 | $182.40 per year | 20 per month | 40 per month |
| Studio | $39 | $374.40 per year | 40 per month | 80 per month |
Prices are in US dollars and exclude tax (§7.1).
Free has no time limit and needs no card. A Free account receives 2 models and 6 AI photos once, when its email address is confirmed; they are valid for 12 months and do not renew. Free also includes repair of 3 of your own files per month (§5.9). To make more models on Free, buy a model pack (§5.3) or choose a plan. A Free account registered before 28 October 2026 keeps its monthly Free quota — 2 models and 6 AI photos, reset on the first day of each calendar month (UTC) — until 27 November 2026; after that, Free gives no monthly models or photos. One Free account per person: accounts created to obtain additional Free models or photos may be closed, and a second account registered to the same mailbox does not receive the Free models and photos.
Every plan, Free included, can make every model in High Quality with multicolour export and includes the full editor — engraving of text, logos, and QR codes, colours, and manual painting. Plans differ in how many models and AI photos they include, the licence (§8.2), queue priority (§6.3), the Studio return (§6.4), support response time, and file retention (§8.4), as set out here and on the pricing page.
Subscriptions renew automatically at the end of each billing period until you cancel; cancellation takes one click and is available at any time (§5.6). Before an annual subscription renews, we email you a reminder 15 to 30 days in advance, with the amount, the date of the charge, and a link to cancel.
Annual billing gives a 20% discount and changes only how often money is charged: the model and photo quotas remain monthly and are granted on the same day each month. Your quota period on a paid plan is therefore always one month, starting on your billing date each month. All spending rules apply identically to monthly and annual billing.
For print farms and studios with volumes above Studio, we offer individual terms under a separate agreement: write to [email protected]; we reply within 24 hours.
5.3 Model packs
You can buy a pack of models at any time, on any plan, Free included; a pack does not change your plan and does not renew anything. Each purchase is a separate pack with its own balance and expiry.
| Pack | Price | Per model | Available on |
|---|---|---|---|
| 3 models | $4.99 | $1.66 | Free |
| 5 models | $6.99 | $1.40 | Free |
| 10 models | $12.99 | $1.30 | Free |
| +5 models | $4.99 | $1.00 | Hobby, Maker, Studio |
| +10 models | $9.99 | $1.00 | Hobby, Maker, Studio |
| +25 models | $22.99 | $0.92 | Hobby, Maker, Studio |
Packs are bought from your account only. To protect against card fraud, one account can buy at most three packs a day, and the payment for a pack may ask your bank to confirm it (3-D Secure). Packs of 10 models for $10 bought before this version keep their terms; they are no longer sold.
A pack contains models only. On paid plans, AI photos come from your plan's monthly pool or, beyond it, from your models at half a model per photo (§5.1); on Free, models from a pack are never spent on AI photos.
Models from a pack are valid for 12 months from purchase. Changing plans does not take them away, and if your subscription is cancelled they stay on your balance within their validity period.
Models from a pack are generated like any other model (§5.1). The scope of rights and queue priority are determined by the plan in effect at the moment a model is spent (§6.3, §8.2) — personal use only on Free and Hobby. The files of a model generated from a pack are kept for 12 months from generation, or longer if your plan keeps them longer (§8.4). The return in §6.4 is a Studio feature and does not depend on how a model was paid for.
5.4 Reset and spending order
Monthly quotas do not roll over: models and AI photos that are unspent when a new quota period starts expire. Model packs are the way to keep models for later — they last 12 months and are not affected by the monthly reset.
Spending order for models: the current quota period's quota, including models given back under §6, first, then models from packs, rewards (§5.10), and Free's models (§5.2), earliest-expiring first. Spending order for AI photos: on paid plans, the monthly pool first, then half a model per photo from the same order; on Free, the AI photos Free includes. Your account log shows which source each operation was spent from.
A generation can be started while at least one model remains; an AI photo beyond the pool, while at least half a model remains. Nothing is spent beyond your balance.
The expiry date of each pack, reward, and of Free's models is shown in your account; no later than 7 days before a pack you bought expires with models left, we send a notice to your email address.
5.5 What models and photos are, legally
Models and AI photos are a prepaid right to use the Service. They are not money, a payment instrument, or property; they cannot be transferred between accounts, sold, exchanged, or cashed out, except for refunds under §7 and §14.
5.6 Changing plans and cancelling
Upgrades take effect immediately: the payment provider calculates a prorated charge for the rest of the period, your quota becomes the quota of the new plan less what you have already spent in this quota period, and the new plan's features are available at once.
Downgrades take effect at the start of the next billing period. Files you have already created keep the retention period of the plan they were created on (§8.4).
Cancellation takes one click and stops renewal; access, features, and quotas remain as they are until the end of the paid period, for monthly and annual subscriptions alike. Models you already created remain downloadable for the retention period in §8.4, and usage rights already granted remain yours permanently (§8.2).
5.7 Running out of models or photos
When your models or photos run out, nothing is charged or purchased automatically. We show you the choice: buy a model pack, choose a plan or upgrade with a prorated charge, or wait for your plan's next quota period.
5.8 Price changes
We give notice of a change to your plan's price by email no later than 60 days in advance. The new price applies starting with the first charge after that period ends. If you do not agree, you can cancel before that date; access continues until the end of the period you have already paid for.
5.9 Repair of your own files and fair use
Repairing your own STL, GLB, and 3MF files does not spend models or photos. On Free, you can repair 3 files a month. On paid plans there is no monthly count; after 50 files a month on Hobby, 150 on Maker, and 300 on Studio, further repair jobs are queued behind other work and complete more slowly. We may apply the same queueing to any other free operation that places unusual load on the Service. Fair use never charges you and never deletes anything.
5.10 Invitations, promo codes, and rewards
Invitations. Every account has a personal invitation link in Settings. A person who creates an account through it — or adds its code in Billing within 7 days of registering and before their first payment — receives 2 models once their email address is confirmed. The account that invited them receives 2 models when that person's first payment — for a plan or a model pack — goes through, however long after registration. An account can be invited only once, and you cannot invite yourself.
Promo codes. Our partners, such as creators, may give out promo codes. A promo code gives what it states: a discount on the first payment or payments of a monthly plan, models at registration, or both. You can add a promo code when you register or in Billing at any time before your first plan payment; a newer promo code replaces the earlier one, and models at registration from promo codes are given once per account. An invitation and a promo code can be used together. Discounts are not combined: when more than one discount could apply to a payment, the one that gives the lower price applies, and it is applied at checkout by our merchant of record (§7.1).
Share your print. If you publish a public post showing a print made with PHORM and send us its link in Settings, a person reviews it and may add 3 models to your account — one such reward per calendar month. Whether a post qualifies is our decision.
Rewards. Models received under this section are added to your balance as a pack valid for 6 months. They are spent after your plan's monthly quota, if you have one, earliest-expiring first, together with models from packs and Free's models (§5.4), and are generated like any other model (§5.1). They are free: they have no cash value, cannot be refunded, and are subject to §5.5. If the payment that earned an invitation reward is refunded in full or withdrawn from (§7.3, §7.4), the unspent part of that reward is removed.
Fair play. Rewards are for real people. We may refuse a reward, remove unspent rewarded models, or act under §14 where accounts are created or used to collect rewards — for example, inviting yourself through another account, or registering several accounts for models at registration. We may change or end these programmes at any time; models already credited stay on your balance until they expire, except as this section describes.
6. If a generation fails
6.1 A failure on our side
If a generation does not complete because of a Service failure — a pipeline error, a provider outage, a timeout — the model is not charged. It is returned to your balance automatically and does not consume any of the limits in this section.
6.2 The result failed our check
Every generation runs through our printability validator. If a result fails the check for the first time for a given source image, that attempt is not charged, and you can try again on the same image. The next attempt on that image is charged like any generation, whether it passes or fails the check again: some source material cannot produce a printable model, and every further attempt spends real resources just like a successful one.
A result that completes and passes the check counts as a delivered generation and spends a model — including when it does not match your expectations of look or detail.
6.3 The Studio priority queue
Studio generations run in a priority queue: at peak load they are processed ahead of generations from other plans.
6.4 Passed the check but did not print (Studio)
If a file passed our validator and still did not print on your printer, on the Studio plan you can return the model to your quota — from the generation log or by contacting support — with no proof or explanation required: up to 3 returns per quota period, within 30 days of the generation, once per model, and only for your own generations. Returned models are credited to the current quota period's balance and expire with it.
7. Payment, taxes, and refunds
7.1 Merchant of record
Orders are processed by our online reseller and merchant of record, Dodo Payments: it sells you the subscription or pack, processes the charge, calculates and remits applicable taxes (VAT, sales tax, GST), issues the invoice, and also handles order-related inquiries and returns. In practice, the fastest route for any refund or charge question is [email protected]: we handle it and instruct Dodo Payments to issue the refund. On your card statement the charge appears as "DODOPAY_" followed by our name. Prices are shown in US dollars and exclude tax; the tax that applies in your country is calculated by Dodo Payments and added at checkout — the full breakdown is shown before the charge.
The purchase itself is governed by Dodo Payments' Buyer Terms; in their terminology, this Agreement is the "End User License Agreement." Dodo Payments' Buyer Terms govern the checkout and the processing of your payment; this Agreement governs the Service, rights to the Result (§8.2), rules of use, and everything we promise you about refunds, withdrawal, and cancellation (§5.6, §7.2–7.4, §14). Where this Agreement provides for a refund, we instruct Dodo Payments to issue it to your original payment method. Cancelling on your Billing page stops the next renewal even in the last 48 hours of a period; if a renewal is charged after you cancelled there, we have it refunded in full. In Dodo Payments' customer portal, cancel at least 48 hours before the renewal date.
You can cancel a subscription in one click on the Billing page of your account or in Dodo Payments' customer portal; you can change your payment method and download invoices in the customer portal, linked from your account.
7.2 Refunds
Payments are non-refundable, except as set out in this section, if we discontinue the Service (§14), and as required by law. Cancelling a subscription stops its renewal; you keep access, features, and quotas until the end of the period you paid for — a month for monthly billing, a year for annual billing.
Changed your mind. If you ask within 14 days of a subscription charge, and no more than 3 models have been spent since that charge (every two AI photos count as one model), we refund the charge in full — on request, with no form and no questions asked. This applies to monthly and annual subscriptions alike.
Model packs. If nothing from the pack has been spent, a full refund is available within 14 days of purchase, no questions asked. A partly spent pack is not refunded, except as required by law.
Anything else. Write to support: we review each case individually and aim to be fair. Systematic abuse of refunds (repeating cycles of pay, use, refund) can be grounds for declining a further refund and closing the account.
Refunds under this section are paid by Dodo Payments, as merchant of record, on our instruction, back to your original payment method; a renewal charged after you cancelled on your Billing page is refunded in full (§7.1). Dodo Payments may also refund a payment under its own Buyer Terms, for example to prevent a chargeback. A refund has the same effect whoever issues it.
If something went wrong with a payment, write to us before going to your bank — Dodo Payments' Buyer Terms also ask you to contact it before raising a chargeback: a refund under this section is usually faster than a dispute and does not affect your right to dispute a charge.
7.3 Statutory rights to cancel
EU and UK consumers. If you are a consumer in the EU or the United Kingdom, you have a statutory right to withdraw from a subscription or a model pack within 14 days of buying it, without giving a reason. Before you go to checkout, you ask us to start providing the Service immediately by ticking a box; we record that request and confirm it in your purchase email. If you then withdraw, you pay for what has already been performed in proportion to the full price: the share of models you have spent out of all models included in the purchase — every monthly quota of the billing period for a subscription, or the models of a pack.
To withdraw, use the "Withdraw from contract here" button on the Billing page of your account while the withdrawal period lasts, or write to [email protected]; you do not need to use any particular form. Withdrawing is no more burdensome than signing up, and we confirm every withdrawal by email.
Other countries. If the law of your country of residence gives you a right to cancel a distance purchase within a set period without a reason (for example, 7 days in Brazil, South Korea, or Taiwan), that right applies as the law provides, and we may keep an amount proportionate to what has already been performed where the law allows.
Our voluntary refund rules in §7.2 apply independently of these statutory rights; nothing in this section narrows them.
7.4 What a refund changes
When a payment is refunded in full — whether under §7.2, as a withdrawal under §7.3 with no deduction, or by our merchant of record — the models from the refunded transaction are removed from your balance, and the subscription purchased in it ends at once and your account moves to Free; if the refunded payment was a prorated upgrade charge, your account returns to the previous plan for the rest of the billing period. Models from other transactions are not affected. Files you have already downloaded remain yours under §8.2 — we do not try to recall them — but models created against a fully refunded transaction can no longer be re-downloaded. After a partial refund, for example a withdrawal in which you paid for the models you used, a subscription you withdrew from ends on the day of withdrawal, the unspent models of that subscription or pack are removed from your balance, and the results you paid for stay available.
Nothing in this section limits the non-waivable consumer rights you hold under the law of your country of residence.
8. Your materials and your rights
8.1 What you upload
You keep your rights to the images, text descriptions, and files you submit to the Service ("Uploaded Materials"). You grant us a limited, worldwide, non-exclusive, royalty-free licence to store, process, transmit, and transform them solely to operate the Service, provide support, and enforce this Agreement. Part of the processing is performed by third-party compute providers, described in the Privacy Policy; their current list is available on request at [email protected].
8.2 What you get
The geometry files and images the Service creates from your materials (the "Result") are yours: we assign to you all of our rights in the Result, to the extent such rights exist. We are being precise on purpose: legal protection of works created with AI varies by jurisdiction, and a Result may not qualify for copyright protection — the assignment transfers everything there is, but does not create protection where the law grants none.
The nature of the technology adds one more caveat: Results are not guaranteed to be unique. Similar source material may give other users similar or identical results; we do not guarantee exclusivity of a Result and are not liable for such coincidences.
Privacy by default. On every plan, a Result is private: it is not shown to other users and we do not publish it. A share link to a model is created only when you choose to create one, and you can stop sharing at any time. The link is unlisted: anyone who has it can view the model in 3D, and anyone signed in to a PHORM account can also download it. Downloading through a share link gives the downloader only the rights that the owner of the model grants them; if the owner grants nothing more, the downloader may use it for personal, non-commercial purposes only. Stopping sharing does not remove copies already downloaded. The limited licence in §8.1 also covers your Results, solely so that we can store them, deliver them to you, and show them and make them available for download through share links you create; we claim nothing beyond that. The models in the gallery (§8.6) and the examples elsewhere on our website are our own.
The scope of your own use depends on the plan in effect at the moment of generation:
Free and Hobby. You agree to use Results created on these plans for personal, non-commercial purposes only.
Maker and Studio. Any purpose, including commercially: selling prints, selling the files, using them in your products.
The scope set at the moment of generation stays with the Result permanently: downgrading or cancelling does not take away commercial use of what you created on Maker or Studio.
We cannot assign rights we do not hold. If your materials depict an object protected by someone else's copyright, trademark, or design right, or a person whose publicity or privacy rights apply, this section does not give you the right to use, distribute, or sell the Result. To sell a figurine of another person, or its file, you also need their permission to sell it — for a child, the permission of their parent or legal guardian.
We do not use your Uploaded Materials or Results to train machine-learning models. Two narrow exceptions apply. First, we use aggregated, de-identified operational data — mesh statistics, validation outcomes, error rates — to improve the Service; this data does not include your images or models. Second, if we offer a voluntary data-sharing programme, your content is used for training only after you explicitly opt in; opting in is off by default, separate from any other consent under this Agreement, and revocable at any time with effect for the future. Our compute providers receive your data to perform your request; each of them handles it under its own terms (see "Who else touches your data" in the Privacy Policy).
8.3 What you promise us
For every Uploaded Material, you represent and warrant that:
- it belongs to you, or you hold all rights and permissions needed to submit it;
- it does not infringe anyone's copyright, trademark, trade dress, design right, patent, right of publicity, or privacy;
- if it depicts a recognizable living person other than yourself, that person is an adult who has given you explicit consent, or a child of whom you are the parent or legal guardian;
- it does not depict a minor in any sexualized, suggestive, or demeaning context;
- it contains no personal data beyond the image itself — do not upload identity documents, medical images, or other sensitive data;
- it is not technical data controlled under export laws (for example, ITAR);
- submitting and processing it does not violate the law that applies to you.
By uploading a photo, you confirm the statements above for everyone shown in it, and they also apply to any AI photo you create from it. Well-known people are no exception: depicting them without their consent — in a photo or an AI photo — is not allowed.
8.4 Storage
The retention period of a Result is set by the plan in effect at the moment of generation and is not shortened by a downgrade or cancellation:
| Plan at the moment of generation | File retention |
|---|---|
| Free | 30 days from generation |
| Hobby | 3 months from generation |
| Maker | 12 months from generation |
| Studio | 24 months from generation |
| A model generated from a pack (§5.3) | 12 months from generation, or the plan's period if longer |
| A model saved from the gallery (§8.6) | while the model remains in the gallery |
| After account closure | 30 days, then deletion |
Retention applies to finished files — STL, 3MF, and images. Photos, text descriptions, and files you upload are kept as long as the Result made from them and are deleted with it; uploads that do not lead to a Result are deleted after 30 days. Unsaved work in the editor is not part of your history; download your models when you are done. You can download your models and delete any of your files at any time. How personal data is handled is described in the Privacy Policy.
8.5 Feedback
If you send us suggestions, ideas, or comments about the Service, you grant us a perpetual, worldwide, royalty-free, irrevocable licence to use them without restriction and without obligation to you. Feedback is not considered confidential.
8.6 The gallery
The gallery holds models made and selected by our team; they are not other users' Results, and a gallery model you edit does not become your Result under §8.2. Saving a gallery model to your models, opening it in the editor, and downloading or exporting it spend no models or photos.
We grant you a non-exclusive, non-transferable licence to gallery models; we do not assign them to you. You may download them, print them, keep the prints, and give prints away. If your account is on Maker or Studio when you download or export a gallery model, you may also sell prints of it; on other plans, prints are for personal, non-commercial use. On every plan, you may not sell, share (including through a share link), or republish the file of a gallery model, on its own or modified, and you may not use it to train machine-learning models. Editing a gallery model in the editor — engraving, colours, resizing — does not change these terms.
We grant only the rights we hold. If a gallery model depicts a real person, a character, or a brand, selling prints of it may also need the permission of the rights holder, and we may mark such a model as not for sale. If we remove a gallery model because of a rights claim, you must stop selling prints of it when we ask.
A gallery model you save stays in your models while it remains in the gallery. If we remove a model from the gallery, your saved copy and any edits to it are removed too, and we let you know in the app — download what you want to keep. You may keep using files you have already downloaded under this section.
The gallery shows the number of likes, saves, and downloads of each model as a total, without names.
9. Acceptable use
You may not create with the Service — and we may block or remove:
- sexual and adult content, including nude and sexualized figures, any sexualized depiction of a real person, and any sexualized or suggestive depiction of a minor;
- material that infringes intellectual property — recognizable characters, logos, brands, and designs that belong to others. Photographing a protected object in order to reproduce it does not make the result yours;
- depictions of real people other than as permitted in §8.3; face swapping — replacing one real person's face with another's; deepfakes — realistic images of a real person designed to pass as genuine photos of events that did not happen; and any use of the Service to impersonate, harass, or deceive;
- weapons, firearms and their functional parts or accessories, ammunition, explosives, and self-defence tools, whether or not they are legal where you are;
- material promoting violence, hatred, or discrimination against any group;
- anything unlawful under the law that applies to you or to us.
You may not circumvent moderation, collect data by automated means, reverse-engineer the Service, resell access to it, or create automated load beyond normal use. You also may not use Results or any Service data to train, fine-tune, or improve machine-learning models that compete with the Service.
If you sell items manufactured from a Result, or the Result itself under a commercial licence, do not present it to your buyers as entirely handmade where that matters to them: the model's origin is your responsibility to them. Where the law that applies to you requires disclosing that an item or image was made with AI, that disclosure is your responsibility. Images and 3MF files created by the Service carry a marker in their metadata saying that they were made with AI; do not remove it where the law or our providers' terms require it to stay.
Automatic moderation checks uploaded images, text descriptions, and AI photos before any 3D generation starts, uploaded 3D files before they are repaired, and AI photos before they are shown to you; a blocked attempt spends nothing and is logged. Moderation does not catch everything, and you remain responsible for what you create; we also act on reports under §10. Repeated attempts to create prohibited content lead to suspension or termination of access without refund.
10. Intellectual property, likeness, and content claims
If you believe content created or hosted through the Service infringes your intellectual property rights, is otherwise illegal, or breaches §9, send a notice to [email protected] that includes the following (for your own likeness, see "Your likeness" below):
- the work or mark whose rights are infringed, where your own rights are concerned;
- the disputed material, identified precisely enough to locate it;
- why you believe the material infringes your rights or is illegal;
- your contact details;
- a statement of good-faith belief that the use is unauthorized;
- a statement that the information is accurate and, where your own rights are concerned, that you are the rights holder or act on the rights holder's behalf.
We review every complete notice, remove or disable access to material when a claim is substantiated, and terminate access for repeat infringers.
Your likeness. If you appear in content created through the Service without your consent — or your child does — write to [email protected] with a description of the content, where you saw it, and your contact details; we may ask for information reasonably needed to confirm that the content shows you or your child. Within 2 business days of a complete request we disable access to that content, including any share link, and then delete the photo and everything made from it; you do not need a PHORM account to make this request, and the counter-notice procedure below does not apply to it. The account that created the content may be suspended or terminated under §14.
Counter-notice. If your material was removed following a claim and you believe the removal was a mistake, send a counter-notice to [email protected]: identification of the removed material, your contact details, and a statement of good-faith belief that the removal resulted from error or misidentification. We forward the counter-notice to the claimant; if within 14 business days the claimant does not confirm that court proceedings have been initiated, the material may be restored.
Knowingly false claims and counter-notices carry liability for the sender, including damages and costs of the party harmed by the wrongful removal or restoration.
11. Availability and no warranties
The Service is provided "as is" and "as available." We do not guarantee uninterrupted operation or the outcome of printing on your specific equipment: filament properties, printer condition, and slicer settings are outside our control. Our obligations for a failed generation are described in §6 — they are our quality guarantee, and they apply without prejudice to any statutory conformity rights you have as a consumer.
Always check a file in your slicer before printing. A Result is a reconstruction from an image: for parts with fitting dimensions, verify critical measurements with a measuring tool before printing. You are responsible for the safe operation of your own equipment.
Physical objects. You alone decide whether to print a Result and what to do with the printed object. You are responsible for the legality, safety, and suitability of anything manufactured from a Result — in particular objects that bear load, are used by children, come into contact with food, form part of a medical or protective device, or are otherwise safety-critical. A Result is a geometry file, not a tested product: we make no representation that a printed object is fit for any such use.
To the maximum extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or punitive damages, lost profits, lost data, spent filament, damage to printers, or business interruption.
Our total liability is limited to the greater of: (a) the amount you paid for the Service in the 12 months before the event, or (b) 50 US dollars.
Nothing in this Agreement excludes or limits our liability for intent or gross negligence, for harm to life or health, or any other liability that cannot be excluded or limited under the law that applies to you. If a jurisdiction does not allow a particular limitation above, it applies to the maximum extent that jurisdiction allows, without affecting the rest.
13. Indemnity
You will indemnify us against claims, losses, and expenses, including reasonable legal costs, arising from your Uploaded Materials, your Result, objects manufactured from a Result, your use of the Service, or your breach of this Agreement — in particular, any third-party claims of infringement of their rights. This section does not apply to the extent a claim is caused by our intent or gross negligence. If you are a consumer, this section applies only to the extent permitted by the law of your country of residence.
14. Suspension and termination
By you. You can close your account in settings at any time, or by writing to [email protected] from your account email. Closing the account ends the subscription, and all unspent models and photos expire — including models from packs; a refund is available only under §7.2 and §7.3 or as required by law (for example, an untouched pack within 14 days of purchase, or a subscription charge within 14 days with no more than 3 models spent). Spend your models, or request that refund, before closing. Files are stored for another 30 days (§8.4) — download the models you need before closing.
By us. We may suspend or terminate access for a breach of this Agreement, at the requirement of law or our payment provider, or on reasonable suspicion of fraud. On termination for breach, unspent models and photos expire without refund, except where the law of your country requires otherwise; rights to Results already granted under §8.2 remain, unless the Result itself violated §9.
Inactive accounts. If an account has no active paid subscription, holds no files still within their retention period under §8.4, and has not been signed in to for 18 months, we may close it after 30 days' notice by email; the remaining account data is then deleted as described in the Privacy Policy.
Discontinuation. We may discontinue the Service, or a paid feature of it, with at least 30 days' notice by email. In that case we refund the unused part of any subscription period you have paid for and the unspent part of model packs, pro rata, and your models remain downloadable for 30 days after the discontinuation date.
Sections 7 (as to refunds and withdrawal), 8.1 (as to the licence granted), 8.2, 8.3, 8.4 (as to files kept after closure), 8.5, 8.6 (as to gallery models already downloaded), 9 (as to the use of Results), 10, 11, 12, 13, 14 (as to the effects of termination and discontinuation), 15, and 17 survive termination.
15. Governing law
Before going to court, the parties will try to resolve a dispute by negotiation: send a description of the dispute to [email protected], and for 30 days we will look for a resolution in good faith. This step does not limit rights that cannot be limited and does not prevent seeking interim relief.
This Agreement is governed by the law of the Republic of Kazakhstan, without regard to its conflict-of-law rules. Disputes are subject to the jurisdiction of the courts of Almaty, Republic of Kazakhstan.
If you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction with non-waivable consumer protections, this section does not deprive you of those protections or of the right to bring proceedings in the courts of your place of residence.
16. Changes to this Agreement
We may change this Agreement. We announce material changes by email and in the interface no later than 30 days before they take effect. Except as set out below, continued use after that date means acceptance. If you do not agree, you can cancel your subscription before that date: until the end of the period you have already paid for, the previous version continues to apply to you, unless the change is required by law or is not to your disadvantage. You can also close your account under §14.
17. Miscellaneous
If a provision is invalid, the rest remain in force. Not enforcing a provision does not waive it. You may not assign your rights under this Agreement; we may assign ours in a reorganization or sale of the business, with notice to you.
Force majeure. Neither party is liable for non-performance caused by circumstances beyond its reasonable control: natural disasters, war, acts of terrorism, civil unrest, acts of public authorities, or large-scale failures of communication networks, power supply, or third-party infrastructure. Payment obligations for services already delivered are not affected by force majeure.
Notices. We send legally significant notices to your account's email address and/or display them in the Service interface; a notice is considered received when sent to your current address. Keep your address up to date. Notices to us go to [email protected] (intellectual property notices — to [email protected], likeness requests — to [email protected], as described in §10). By using the Service, you agree to receive communications electronically.
Language. This Agreement is published in English. If we publish a translation, the English version prevails in case of discrepancy.
This Agreement, together with the pricing page, the Refund Policy, and the Privacy Policy, is the entire agreement between us about the Service; the payment itself is also governed by Dodo Payments' Buyer Terms (§7.1).
